In a May 2023 ruling, the Supreme Court was deeply indignant at the fact that even a decade After the enactment of the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 (POSH Act), serious gaps remained in its effective implementation.

He stressed that all state officials, public authorities, private companies, organizations and institutions are required to implement the POSH Act in letter and spirit.

Therefore, he had requested the Union and State Governments to take positive steps and ensure that the objective behind the enactment of the POSH Act is achieved in real terms. He had also named lawyer Padma Priya as amicus curiae in this matter.

It had, therefore, issued directions to ensure strong and effective compliance with the POSH Act and asked the government to file affidavits in this regard.

Rightly, the Court warned that the law will never succeed in ensuring the dignity and respect that women deserve in the workplace, unless and until there is strict compliance with the employment regime. enforcement and a proactive approach by all state and non-state actors.
