Kochi: The Kerala High Court will on December 12 hear detailed arguments in the petition filed by Manjusha, wife of ADM Naveen Babu, regarding his death. The court observed that it could examine whether the investigation was moving in the right direction. He also noted that evidence would be needed to claim the investigation was biased. Judge Kauser Edappagath reviews the motion.

The court was hearing a plea filed by Manjusha seeking a CBI probe into her husband’s death. The court, while hearing the plea, said it may assess whether the case should be handed over to the CBI. To decide, the court will carefully study the file journal. He stressed that sufficient evidence would be required to transfer the case to the CBI. Only if it turns out that the investigation is not proceeding properly or there are shortcomings can the case be transferred to another agency. The court also emphasized that a detailed examination of the case diary would shed light on these issues.

The case diary would contain all the details, including statements taken from the individuals and evidence collected. If the CBI is to take over the investigation, there must be valid reasons, which the court intends to verify through the case diary, Justice Kauser Edappagath said.

The court also asked the government for details on the findings of the autopsy report. The government informed the court that there were no external injuries on the body of Naveen Babu. If there was any suspicion of murder, the court asked the petitioners why this was not raised while considering the accused’s bail application.

The government submitted an affidavit claiming that the investigation was progressing satisfactorily, there were no lapses and there was no need for a CBI probe. He assured the court that the files would be examined, thereby enabling the court to make an appropriate decision.
