Delhi court vacates order closing cheating case against Gautam Gambhir; also asks ED to examine

Special judge Vishal Gogne on October 29, said the release order passed by the district court reflected a “inadequate expression of mind” to resolve the allegations against Gambhir, who was a Member of Parliament (MP).

The Court found that the allegations against Gambhir merited further investigation as he was the only one to “who actually had a direct interface with investors, in his capacity as brand ambassador.”

He also referred to Gambhir’s role in Rudra and asked if any of the investors’ money had gone to him.

“Though the said accused was released, the impugned order made no reference to the huge amount of ₹6 crores which he had paid to Rudra and the sum of ₹4,85,00,000 which he had received from the The indictment did not specify whether the amounts reimbursed to him by Rudra were related to or came from funds received from investors in the project in question. said the Court.

He further observed that Gambhir apparently had financial dealings with the company beyond his role as brand ambassador since he was an additional director of Rudra from June 2011 to October 2013.

“Yet, the impugned order generalizes the findings against the named accused (Gautam Gambhir) by combining the findings against him with the observations of the court regarding other accused (not named in the complaint),” noted the Court.

Pertinently, the judge also observed that since cheating is an offense under the Prevention of Money Laundering Act (PMLA), the matter may have to be probed by the Enforcement Directorate (ED ).
