High Court sends accused to hospital after family claims police assault

The Bombay High Court on Wednesday ordered hospitalization of an accused who was allegedly brutally assaulted by police officers during his arrest. Citing a report of the High Court doctor, the bench also ordered a further examination to assess his health condition.

The order came a day after the accused, Anil Rathod, was produced before the trial court and remanded to police custody on November 5. According to Rathod’s lawyer, he informed the court that police officers assaulted him with a belt, leaving his back seriously injured. bruised.

Lawyer Priyanka Dubey requested the magistrate court to personally question Rathod. The court noted, however, that the police took him to the hospital for a medical examination within 24 hours of his arrest and that the doctor’s report showed no signs of injuries due to assault. He was subsequently taken into custody.

The same day, Rathod’s brother Sunil filed a petition in the High Court. His lawyers, Nimay Dave and Megha Gupta, said police initially arrested and assaulted Rathod on November 4, before briefly releasing him after a brutal confrontation. Rathod then reportedly sought medical attention, but police apprehended him again later in the day and officially recorded his arrest.

The police action, according to lawyers, was linked to a cheating case involving Rs 1.3 crore allegedly linked to Rathod’s father. His lawyers argued that Rathod was not even named in the FIR.

After examining photographs of Rathod’s injuries, High Court judges Arif Doctor and Somsekhar Sundaresan summoned the Maharashtra police officers to court. In response to the “serious and serious allegations of physical abuse”, the court ordered the High Court doctor to examine Rathod. The officer confirmed the injuries and recommended further treatment.

The court ordered that Rathod be treated at the state-run JJ Hospital, where he will undergo necessary examinations and receive appropriate care.
