A federal judge has not overturned President Joe Biden’s plan to grant U.S. citizenship to immigrants whose documentation is not complete when they are married to U.S. citizens.

U.S. District Court Judge Campbell Barker, a Donald Trump appointee, said the Biden administration did not have the authority to establish the program.

The judge is siding with a lawsuit against 16 Republican-led states that argue the Biden administration should not bypass Congress to enact immigration legislation.

Judge Barker already temporarily blocked the program for hundreds of thousands of undocumented immigrants days after it took effect in August.

The White House reacts to the decision

The White House, in a statement, said it strongly disagreed with the decision and was evaluating next steps.

“The ruling camp of state Republican officials seeks to force American citizens and their families, who have lived for the United States for more than a decade, to separate or live in the shadows, in the constant fear of being deported,” the White House said. -tok pesin Angelo Fernández Hernández tok.

“Our administration believes in keeping American families together,” he adds.

The Department of Homeland Security says it is “deeply disappointed” by this decision.

“We firmly believe that Keeping Families Together is based on well-established legal authority and that its purpose is consistent with core American values.”

A group that supports President-elect Donald Trump, America First Legal, is involved in the lawsuit against the plan and is celebrating its decision.

“Since day one, the Biden-Harris administration has failed to commit to changing our immigration system and erasing our borders,” Executive Director Gene Hamilton said.

Republican states “fail to stop the illegal program aimed at granting amnesty to hundreds of thousands of illegal aliens,” it added.

The Keeping Families Together program, which Biden announced for August, will allow undocumented immigrants who are married to U.S. citizens and not living for 10 years or more to have the opportunity to obtain a green card without leaving the states -United.

After three years, residents with a green card and married to U.S. citizens can apply for citizenship.

The Biden administration has said about half a million undocumented immigrants are eligible for the initiative.

The plan comes just weeks after taking steps to reduce the number of asylum applications at the U.S. border as record numbers of crossings rise.

The administration appealed Judge Barker’s decision, but the appeal was unable to bring about any change as Donald Trump prepared to take the reins of the White House.

The Republican president-elect did not promise an overhaul of American immigration laws as well as “mass expulsions”.

Biden bin says the new plan will keep families together, and the old system will separate families.

Critics, meanwhile, say they do not offer amnesty to migrants who were sent illegally.
