Court grants extension to police to investigate Cadila CMD in rape case

Ahmedabad: Four months after the Ahmedabad Rural Court refused to accept a closure report, the Sola High Court police have sought another extension from the court to further investigate the rape complaint filed by a Bulgarian v Rajiv Modi, CMD of Cadila Pharmaceuticals Ltd. A judicial magistrate Ahmedabad Rural Court adjourned the case last week granting police time till December 10. This was the second extension to investigate the case.
Regarding the extension sought by the police, the complainant’s lawyer Rajeshkumar Mishra said, “After the court ordered further investigation, the police recorded the statements of some of the witnesses we called, the version of which , in our opinion, was an essential element of the investigation. Although we insisted on interviewing these witnesses, the police deliberately ignored us. It is good that investigators are doing this now. » In her protest petition, the complainant listed the names of witnesses the police should have questioned.
Earlier in August, the court granted police two more months to investigate the case. This happened after the court’s decision on June 29, in which it did not accept the closure report filed by the police. The closing report took a clear swipe at Modi and a Cadila employee, Johnson Mathew, stating that there was no concrete evidence against them. The complainant vehemently objected to the summary report and alleged that the police were biased and failed to properly investigate the matter.
The court refused to accept the closure report and ordered the investigator to investigate further and file a report by August 31. Since then, investigators have twice requested an extension.
According to the details of the case, a few months after her employment, the Bulgarian filed a police complaint accusing the harassment of Cadila CMD Rajiv Modi in April 2023. The company paid a certain amount for the settlement of a dispute on duty but did not register an FIR. on her allegations of sexual harassment and abuse by Modi. His request to register an FIR was rejected by the magistrate court last year.
It was on the instructions of the Gujarat High Court that the police launched an investigation but filed a closure report in February stating that after questioning numerous witnesses, they had not found adequate evidence to support the rape charge.
The magistrate court did not accept the report, saying failure to record statements of important witnesses was hampering the trial and these witnesses should be questioned. The court also said that the police ignored important documents and electronic documents. The court observed that the investigator failed to investigate the allegations of human trafficking by Cadila and her management and ordered an investigation into the role of all those allegedly linked to the matter.
