TN BJP demands setting up of special court to probe cases against cops

Tamil Nadu BJP spokesperson and senior party leader ANS Prasad has asked the state government to set up a special court to probe cases against police personnel.

In a statement issued on Tuesday, Prasad said that to give weight to the landmark judgment of the Supreme Court, the Tamil Nadu government must set up a special court to investigate cases against police personnel.

He said the move was crucial to preventing situations in which citizens are falsely implicated and subjected to police brutality.

It may be recalled that the Supreme Court of India passed a historic judgment, allowing cases to be filed against police officers who falsely implicate individuals in cases and detain them.

ANS Prasad said this historic verdict aims to curb abuse of power by police officers and ensure protection of human rights of individuals.

In light of this judgment, it is imperative that the Tamil Nadu government establishes a special court to expedite the trial of these cases and deliver justice quickly, the BJP leader said.

He added: “This will not only strengthen the rule of law, but also strengthen citizens’ confidence in the justice system. » Prasad said the Supreme Court judgment, ruling that prior sanction is not necessary to prosecute police officers accused of filing false complaints or fabricating evidence, aims to prevent police officers from abusing their powers and their position to harass innocent citizens.

He said the top court’s decision sets an important precedent in ensuring accountability of police officials and preventing abuse of power.

He said the bench, comprising Justices JB Pardiwala and Manoj Misra, held that the protection provided under Section 197 of the Code of Criminal Procedure (CrPC) cannot be extended to police officers who misuse or misuse their powers.

The BJP leader said the court emphasized that filing a false case or fabricating evidence is not an official duty and hence police officers cannot claim immunity under Section 197 of CrPC .

ANS Prasad said the judgment was a welcome step forward in ensuring that police officers were held accountable for their actions.

Prasad said the recent withdrawal of police protection from Justice S. Manikumar, chairman of the Tamil Nadu State Human Rights Commission, has raised concerns about the safety and security of human rights defenders. human rights in the state.

He said the incident not only compromised the safety of Justice Manikumar but also undermined the independence and autonomy of the commission.

He added that the Tamil Nadu government’s failure to provide protection to Justice Manikumar, a former High Court judge, raises questions about its commitment to protecting human rights defenders. He said the incident had raised concerns about the safety and security of ordinary citizens who approach the commission seeking justice.

Prasad said the Supreme Court’s landmark ruling set a precedent that allows individuals to approach the courts directly to protect themselves against police harassment and intimidation.

The BJP leader also said the judgment has restored the confidence of human rights defenders in the judiciary and sent a strong message to the state government to respect the independence and autonomy of the commission human rights.
