New Delhi, December 24 (IANS): The Delhi High Court on Tuesday agreed to consider a plea filed by several BJP legislators requesting the Speaker of the Delhi Legislative Assembly to convene a special session for tabling of CAG reports.

A bench of Justice Sanjeev asked the Delhi government, Assembly Speaker and other respondents to file their response in the matter by January 9, 2025.

The bench headed by Justice Narula also took note of the contention that Chief Minister Atishi, who also holds the portfolio of Finance Minister, forwarded to the President the CAG reports approved by the Lieutenant Governor (LG) .

Earlier on Monday, the plea filed by the opposition MLAs was mentioned before Acting Chief Justice (ACJ) Vibhu Bakhru, who ordered that the plea be listed in the ordinary course.

The much-delayed CAG reports allegedly discuss the city government’s alleged lapses related to the now-withdrawn excise policy, anti-pollution drive and other matters of state finances that could embarrass the run government by the AAP just before the Assembly elections. .

The latest plea filed by BJP MPs Vijender Gupta, Mohan Singh Bisht, Om Prakash Sharma, Ajay Kumar Mahawar, Abhay Verma, Anil Bajpai and Jitender Mahajan says a special session of the Delhi Legislative Assembly was not summoned by the president despite a declaration made. before the Delhi High Court in an earlier round of litigation.

“This is a blatant violation of the statement/undertaking given by the senior counsel on behalf of GNCTD before this honorable court for which the petitioners reserve the right to seek contempt of court if informed ” he said.

Last week, the Delhi HC responded to BJP legislators’ demand for the city government to forward the CAG reports to the Lieutenant Governor (LG) after learning that LG Vinai Kumar Saxena had approved all 14 reports of the CAG forwarded by Chief Minister Atishi. .

He noted that CM Atishi, who also holds the portfolio of Finance Minister, will within 2-3 days forward these approved reports to the Speaker of the Delhi Legislative Assembly, who, in turn, will promptly respond to the call for holding an extraordinary session for installation. in CAG reports.

The petition said that the CAG is a “constitutional oversight body” established with the aim of providing independent and credible assurance to the public, the legislature and the executive that public funds are collected and used effectively and efficiently.
