Brothers’ Argument Ends in Shooting, Arrest by Las Vegas Police

LAS VEGAS, Nev. (FOX5) – Las Vegas police responded twice to an argument between brothers on Christmas Eve. It ended in a police shootout and an arrest.

The shooting happened around 12:45 p.m. in the 3200 block of La Barca Lane.

Las Vegas police twice responded to an argument between brothers and it resulted in a police shooting and an arrest.

The police received two calls. The first occurred around 7:48 a.m. Police arrived to find suspect Donald Eubank arguing with his brother. Eubank told police he wanted to evict his brother and allow him to get his property back.

The police waited until the brother reclaimed his property before evacuating the scene.

At 10:24 a.m., police received another call to the same home. It was about Eubank and his brother arguing again as his brother got more stuff from the property.

Metro spoke to a woman who said Eubank threatened them both with a gun. Police began cordoning off the scene and asked Eubank’s brother and the woman to leave the area.

The scene was considered a barricade.

Eubank would be seen entering and leaving his house. The first time, he used a knife to damage a Metro patrol vehicle.

The next two times, police said Eubank was armed with a gun and pointed it at officers.

Police attempted to separate him from his weapon and prevent him from reaching him with less-lethal options such as bean bag bullets.

However, surveillance video shows Officer Christian Espinoza firing his rifle twice. The two did not touch the suspect.

Eubank was hit with a Taser and fell. Police moved in with SWAT and took him into custody.

Eubank was taken to hospital where he was treated for “minor” injuries. He was booked into the Clark County Detention Center on the following charges:

  • Assault with a deadly weapon
  • Alteration of a vehicle, damage over $5,000
  • Four counts of assault with a deadly weapon on a protected person
  • Resisting a public officer with a firearm

This is the 17th officer-involved shooting in LVMPD jurisdiction this year.

Police say Officer Espinoza is 32 years old and has worked for LVMPD since 2020.

He is currently posted to the Community Policing Eastern Division, South East Zone Command. He has been placed on routine paid administrative leave pending the outcome of a review of this incident.
