New Delhi (India), December 4 (ANI): A bill to replace the Aircraft Act, 1934 for ease of business and ensuring manufacturing and maintenance in the aviation sector was proposed in Rajya on Tuesday Sabha.

Civil Aviation Minister Kinjarapu Rammohan Naidu moved the Bharatiya Vayuyan Vidheyak, 2024 for consideration and adoption in Rajya Sabha.

The Loksabha has already passed the bill.

Naidu later said in a social media post that the bill was a historic step towards modernizing India’s aviation framework, aligning with global standards and promoting growth of the aviation sector.

According to the objects and reasons of the bill, the Aircraft Act of 1934 was enacted to better provide for the control of the manufacture, possession, use, exploitation, sale, import and export of aircraft.

The regulation of civil air transport in the territory and airspace over India, including the regulation of international air services of domestic and foreign air carriers, is a sovereign function of the Government of India and is implemented under this Act, having regard to international regulations, bilateral and multilateral agreements and arrangements to which India is a contracting party or to which India has acceded or ratified.

The statement said the Aircraft Act, 1934 has been amended several times to improve safety, surveillance, meet the requirements for sustainable growth of the aviation sector and give effect to the provisions of international conventions.

“Following numerous amendments over a period of ninety years, there is a need to remove ambiguities and confusion experienced by stakeholders, remove layoffs, ease of doing business and ensure manufacturing and maintenance in the aviation sector. and to reinstate the law in the form of a Bill – Bharatiya Vayuyan Vidheyak, 2024.”

The Bharatiya Vayuyan Vidheyak, 2024 aims to ensure design, manufacture and maintenance of aircraft and related equipment, to empower the Central Government to regulate the issuance of Radio Telephone Operator (Restricted) Certificate and License in order to facilitate affairs and to establish rules to implement the Convention on International Civil Aviation and other matters relating to civil aviation security.

It also seeks to authorize the Central Government to issue emergency orders in the interest of public safety or tranquility, to provide for the payment of compensation for loss or damage in the manner prescribed by law and to provide appeals against matters relating to compensation. license, certificate or approval and determination of sanctions.

The bill provides for imprisonment, fines or penalties for violation of the provisions of the law or rules, besides eliminating ambiguities and redundancies.
